Distribution to phonogram producers

Reorganization of the Distribution System for the Audio Producers as of 2018

Several years ago SWISSPERFORM initiated a renewal of the distribution system for the phono producers. The objective is to change the current turnover-related distribution system to a method which is based, as far as possible, on the actual use of recordings. The new “use-related distribution” calculates the remuneration on the basis of airplay (radio and television / SRG and private broadcastersbroadcasters

As of 2018 (distribution year 2017) SWISSPERFORM will distribute according to the new use-related system. 

 

The new distribution system can be described as follows: 

 

The major part of the distribution sum will be distributed in a “use-related manner”. The remuneration will be calculated on the basis of the airplay of selected radio and television broadcastersbroadcasters

A relatively small part of the distribution will still be distributed according to the commercial market shares – i.e. in a „turnover-related manner“. This covers the sectors (e.g. private copying) the actual use of which cannot be determined in detail or can only be determined with a disproportionate amount of time and effort, respectively. This covers, in particular, the revenues from the blank media levy.

 

However, a distribution of this part of the proceeds according to commercial market shares only applies to recordings of domestic producers. Thus, if your domicile as phono producer is in Switzerland or if you represent a Swiss producer or if you distribute the phonograms of a Swiss producer we will still need the report of your annual turnover with these phonograms in the future. However, we no longer need any turnover report with respect to phonograms of foreign producers. Hence, please only report the turnover achieved with phonograms of Swiss producers. 

 

Accordingly, you do not have to provide us with turnover reports if your domicile as phono producer is abroad or if you only distribute phonograms of producers domiciled abroad. In this case you will receive – from now on – all your remunerations (i.e. including your share resulting from private copying) based on airplay. 

 

With respect to recordings of producers domiciled in Switzerland please report

- on the other hand, your turnovers here.

 

With regard to recordings of producers domiciled abroad please only report your entitlement here.

 

In order to receive remunerations from SWISSPERFORM (from both the “use-related” distribution and the “turnover-related” distribution for phonograms of Swiss producers) it is required that each beneficiary (phonogram producersphonogram producers
This category includes natural persons and legal entities that have the organisational and economic responsibility for authorised productions of phonograms, of which great numbers are intended to be released under a label to the commercial market.
