Members & rights holders

Among those entitled to receive remuneration from SWISSPERFORM are performers (performing artists) and producers (producers of audio and audiovisual recordings), in the audio and audiovisual sectors respectively. If those have their residence or office location in Switzerland or if they are Swiss nationals, they can become membersmembers
Performers, producers and broadcasters can become members of SWISSPERFORM pursuant to Art. 3 of the Articles of Association (german version).

This category primarily includes actors incl. puppeteers, dancers, theatre directors and conductors.

Principals are those who have assigned the management of their rights to SWISSPERFORM but have not become members of SWISSPERFORM.
 
These are usually performers residing abroad and producers who do not have the Swiss citizenship.

This category includes natural persons and legal entities that have the organisational and economic responsibility for authorised productions of phonograms, of which great numbers are intended to be released under a label to the commercial market.

Foreign audiovisual producersaudiovisual producers
This category includes natural persons and legal entities that have the organisational and economic responsibility for the first-time audiovisual or visual recording of a performance or another visual process.

usually receive their remuneration based on rights administration agreements between SWISSPERFORM and foreign collective management organisations based in the producers' country.

 

Another party entitled to receive a share of the remuneration paid by SWISSPERFORM are the broadcastersbroadcasters
This category includes companies broadcasting radio or TV programmes that are subject to an obligation to notify and obtain a licence pursuant to Art. 3 of the Swiss Federal Act on Radio and Television (RTVA).
